Wowzie World Privacy Policy

 

The Wowzie World website, located at, "http://www.wowzies.com/" and/or "http://www.wowzieworld.com" (the “Site”), owned and operated by Quick Start Kids LLC (“we” or “the Company”), is an online virtual theme park for children that employs safety features and privacy practices that are designed to comply with the Children's Online Privacy Protection Act (COPPA).

This Privacy Policy is provided to describe the manner in which we use personal information, including what kind of information we collect, how that information is used, and if that personal information is shared. By browsing, using, or registering on the Site, you signify that you have read, understand and agree to be bound by this Privacy Policy (“Privacy Policy”).

Each child who attempts to register on the Site is required to provide a user name (not their real name) and password. We do not ask children to provide any personally-identifying information about themselves in order to register on or use the Site. Children are asked to "create" a user name that is NOT their real name and provide a password. Children under the age of 13 are not allowed to provide their full real name, their email address or any other personally-identifying information about themselves on the Site. We reserve the right to terminate the membership of any child who violates this policy and attempts to submit personally-identifying information about themselves on the Site. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. In the event that we learn that we have collected personal information from a child under age 13 we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us at "privacy@wowzies.com".

Notwithstanding the previous paragraph, if you use the "Contact Us” feature of the Site, we will require your email address to respond to your question. We will use this information to respond directly on a one-time basis to your specific request, and your email address will not be used to re-contact you, nor will it be maintained by us. We may also need the user name for the account.

If you wish to register as a paid member on the Site, we may request additional personally identifiable information including the Parent's full name, credit card billing information, email address and mailing address. If you pay by credit card, or Pay Pal we will collect financial information necessary to process payments to Wowzie World, and will passively collect your IP address. Your financial information is not retained by Wowzie World; it is stored by our payments processing vendors so they can process credit card payments to Wowzie World. They protect the information with proper security measures by agreeing to maintain the confidentiality, security, and integrity of the personal information obtained from the website. If membership is paid for by credit card or pay-pal, the Parent’s email address will be linked to the child’s account. We use the parent’s email address to email the parent account billing information, send messages regarding the child's use of the account, provide the parent with a link to our privacy policy, and send messages about new Wowzie World features.

Wowzie World does not condition a child's participation in an activity on the disclosure of more personal information that is reasonably necessary for the activity. For example, Wowzie World would not ask for a mailing address in order to send an email newsletter.

Wowzie World uses “cookies” to passively collect users’ IP addresses. A cookie is a parcel of text that is sent back and forth between a web browser and the server it accesses. Cookie information is stored on your computer, not ours. Your browser and other security applications can be set to prompt you when a website is setting a cookie or to reject all cookies. Unless you accept our cookies, you will not be able to use our website effectively, and many site sections and applications will not function properly or at all. This information is only used to help maintain security on the website. If a player does not follow the Wowzie World rules we may use their IP address to permanently ban them from the website. If a membership is paid for by credit card, the IP address provides an additional tool to fight fraudulent financial transactions. We will not share this information with third parties unless: required by law enforcement, to comply with court orders or subpoenas, to protect the safety of users on the website, or to enforce our terms and conditions.

Wowzie World offers features, such as chat rooms, that could allow a user to disclose personal information publicly. However, we have taken precautions to not allow users to communicate personally identifiable information through the Wowzie World Chat feature. Chat messages are subject to an intricate filter and intermittent live moderation. The chat rooms are not moderated by a live person 24 hours a day. However, our filters are on 24/7 and are designed to block the submission of any full name, email address, telephone number, address, or other personally identifiable information. It is against the Wowzie World rules to share any personally identifiable information through the Wowzie World Chat feature. However, we are not responsible for any personally identifiable information that a user chooses to share through the Wowzie World Chat feature and that fails to get blocked by the filtering software. If a user chooses to share personally identifiable information through the Wowzie World Chat feature, that information could be read, used or gathered by other users. Also, some offensive messages could get through the filters.

We authorize a third party to passively collect non-personally identifiable visitor information. This information includes the user's web browser, ISP, operating system, screen colors and resolutions, java use, how often and what they visit in Wowzie World. We use this information to track Site usage and help us make improvements to Wowzie World content and services. This information is collected using "cookies" and Java Script code.

We have put in place appropriate security measures to maintain the confidentiality, security and integrity of the account information collected from users. When a player registers or a parent purchases a membership, the information we collect is encrypted using secure socket layer (SSL) technology. However, no communications over the Internet are 100% secure and we cannot guarantee the security of user account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of user information at any time.

You are responsible for all actions taken with your login information and password. Therefore we do not recommend that you disclose your Site password or login information to any third parties. If you choose to share this information with third parties, you are responsible for all actions taken with your login information and password and therefore should review each third party's privacy policy. If you lose control of your password, you may lose substantial control over your personally identifiable information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password.

The Site may include access to chat rooms, message boards, and other modes of communication. As a Wowzie World member you may have access to other members’ profiles, and you might gain access to other contact information of members through the use of chat rooms, message boards, and other modes of communication. By accepting this Privacy Policy, you agree that, with respect to other members' personally identifiable information that you obtain through your use of the Site, you may only use such information for: (a) Wowzie World-related communications that are not unsolicited commercial messages, and (b) any other purpose that such member expressly agrees to after adequate disclosure of the purpose(s). In all cases, under no circumstances can you disclose personally identifiable information about another member to any third party without our consent and the consent of such other member after adequate disclosure. We do not tolerate spam. Therefore, without limiting the foregoing, you are not licensed to add Wowzie World members to your mail list (email or physical mail) without their express written consent after adequate disclosure. We may use user names or parents’ email addresses to observe how users are following the Wowzie World rules and the Site's Terms of Use. Also, if users break the Wowzie World rules and conduct themselves inappropriately on the website, we may use the parents’ email or username to ban a user from the Wowzie World website. This ban may be temporary or permanent, in our sole discretion. In addition, we may use parents’ email addresses and user names to notify parents about the Wowzie World website. For example, we may send an email regarding an update to our privacy policy new Wowzie World features, services and products.

Except as stated in this Privacy Policy, Wowzie World does not disclose users’ personal information to third parties. We may provide personally identifiable information to our service providers (such as our server company, hosting company, website maintenance company, payment processing vendors, and SMTP server company) to allow us to: directly communicate with you, redesign, maintain, process payments, upgrade or host the Site. Our service providers maintain this information exclusively in order to carry out their obligations to us, and they do not sell or share such information.

Personally identifiable information may be disclosed to third parties when required by law enforcement or other public agencies, to comply with court orders or subpoenas, and to protect the safety of users and the security of the Wowzie World website. We may also share this personally identifiable information if necessary to enforce our terms and conditions.

If another business buys all or part of the assets of Wowzie World or the Company, all information, including personally identifiable information, will be transferred to that business.

Parents may review any personally identifiable information that we collect. Please contact us to access the personally identifiable information that we
have collected about you online, to make corrections to that personally identifiable information if there are factual errors, request that this information be deleted form our database, and request we no longer gather or keep your personally identifiable information. If a user requests that personally identifiable information be deleted from our database, Wowzie World reserves the right to terminate the user’s membership.

The Site may contain links to other web sites. We of course are not responsible for the privacy policies and/or practices on other web sites. When linking to another web site we encourage our users to read the privacy policy stated on each and every web site. This Privacy Policy only governs information collected on the Site.

We reserve the right to change this privacy policy at our discretion. Any changes to the Privacy Policy will be posted with the effective date on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Privacy Policy.
